Alanna Terms of Use
These Terms of Use (the “Terms”) are a binding contract between you and ALANNA APP LLC, a Florida limited liability company doing business as Alanna (“Alanna,” “we,” “us,” or “our”). They govern your use of heyalanna.com, our web application, and our mobile applications for iOS and Android, along with all related services (together, the “Services”).
By creating an account, clicking “I agree,” or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Please also read our Privacy Policy, which explains how we collect and use your information, and our Consumer Health Data Privacy Notice if you live in Washington, Nevada, or Connecticut.
1. What Alanna Is
Alanna is an AI emotional companion built for family caregivers, meaning people caring for a loved one through illness, aging, disability, or another caregiving role. Alanna is designed to be a warm, always-available space where you can process what you are carrying.
Alanna is intended as a general wellness and self-help tool. She is not a substitute for clinical care. The Services do not include the provision of medical care, mental health services, therapy, counseling, or any other licensed or professional healthcare service, and they are not intended to diagnose, cure, mitigate, treat, or prevent any disease or medical condition.
Please understand:
- Alanna is not a licensed therapist, counselor, physician, social worker, or medical provider and does not present herself as, or act as, a licensed mental health professional. Alanna is an artificial intelligence system, not a human being, and does not have human feelings, consciousness, or professional judgment.
- Alanna cannot diagnose any condition, mental health or otherwise.
- Using Alanna does not create a provider-patient relationship between you and us. Any decision about diagnosis or treatment rests with you and your healthcare provider.
- Alanna is not a substitute for professional care. She is not a replacement for in-person healthcare visits, counseling, therapy, psychiatric care, or wellness visits that may be necessary for you. You are welcome to use Alanna alongside professional care.
- Alanna’s responses are generated by artificial intelligence, not a human, and may be inaccurate, incomplete, fabricated, or inappropriate for your situation. Like all AI tools, Alanna is susceptible to errors, including generating information that sounds confident but is wrong. Do not rely on Alanna as a sole source of truth or as a substitute for professional advice. We provide additional in-product notices about Alanna’s artificial nature as required by applicable law.
- Alanna’s responses may not be unique. Other users may receive similar responses.
2. Emergency Resources and Safety Limitations
If you are experiencing a mental health crisis, having thoughts of harming yourself or others, or are in immediate danger:
- Call or text 988 (Suicide & Crisis Lifeline), or chat at 988lifeline.org
- Text HOME to 741741 (Crisis Text Line)
- If you are in immediate danger, call 911
No Guarantee of Detection
Alanna includes automated safety features designed to surface crisis resources when certain language is detected. However, we do not represent or warrant that Alanna will detect any specific psychological, emotional, mental health, or medical issue, or that we will take any specific action if such an issue is detected. We do not review all conversations. You agree that you will not bring any claim against us concerning any failure by us or by Alanna to detect, or to take action in connection with, any apparent mood, emotional state, safety concern, or mental health condition concerning any person.
How Alanna Responds to Crisis Language
If Alanna detects language that may indicate you are in crisis or considering harming yourself or others, Alanna will:
- Show you crisis resources, including the 988 Suicide & Crisis Lifeline and the Crisis Text Line, with contact information and direct links
- Continue to offer support and additional resources if you keep expressing distress, rather than repeating the same referral
- Not provide content that encourages self-harm or that describes methods of self-harm
- Record that a detection occurred and that a referral was shown — a flag and a timestamp, not the content of your message
Alanna remains available to talk with you after showing these resources. Alanna is not a crisis service, does not monitor your well-being, and cannot intervene on your behalf.
Alanna’s crisis detection is automated and imperfect. It may fail to detect real crises or may be triggered by language that was not intended seriously. Regardless of whether Alanna detects anything, if you are in crisis or considering harming yourself, please contact 988, the Crisis Text Line, or 911.
Publication of crisis protocol. A description of our crisis prevention and referral protocol is published on our website at heyalanna.com/crisis and in our applications, as required by applicable law. We maintain and update the protocol to address applicable requirements concerning detection, crisis-resource referrals, and prevention of harmful self-harm or suicide-related outputs. Beginning July 1, 2027, we will maintain records of crisis referrals and report the information required by California Business and Professions Code section 22603, and will publish or report equivalent information where other states require it. These reports contain aggregate counts and protocol descriptions only, and will not contain personal user information.
Automated Safety Screening and Abuse Reporting
If you suspect, have experienced, or have knowledge of child abuse, elder abuse, or abuse of a dependent adult, please contact your local protective services agency or law enforcement.
Alanna does not continuously or routinely monitor private conversations, and no person reads your conversations in ordinary operation. However, automated systems screen messages for a narrow set of explicit disclosures of serious harm to a child or a vulnerable adult. When such a disclosure is detected, an authorized member of our team reviews the flagged message and a limited amount of surrounding conversation. Our Privacy Policy describes this in detail, including the limits on what that person can see and the records we keep of every such access.
Authorized personnel may also become aware of potential abuse, neglect, exploitation, self-harm, or threats through Alanna Allies moderation, customer-support communications, or the limited safety, legal, or Terms-enforcement access described in these Terms and our Privacy Policy.
Florida law requires a person who knows or has reasonable cause to suspect child abuse, abandonment, or neglect (Florida Statutes section 39.201) or abuse, neglect, or exploitation of a vulnerable adult (Florida Statutes section 415.1034) to report as required by law. Other jurisdictions impose their own reporting duties. If our personnel become aware of information that triggers a mandatory reporting obligation, we will report it to the appropriate authorities and disclose information reasonably necessary to comply with that obligation. Where a reporting obligation applies, we report to the appropriate agency in the state where the person at risk is located.
We will not notify you if a report is made. For some reports, federal law prohibits notification. For others, notification could place the person at risk in greater danger.
You are solely responsible for your own safety and for seeking appropriate professional help.
Needs Beyond the Scope of Alanna
Alanna is designed to support caregivers through guided self-help conversation. If your needs appear to exceed what guided self-help can provide, we may encourage you to seek support from a mental health professional, medical professional, or support organization. We reserve the right to limit or discontinue Services where we believe they are not appropriate for a user’s needs.
3. Eligibility and Registration
Age Requirement
You must be at least 18 years of age to use Alanna. The Services are not directed to anyone under 18, and companion chatbots may not be suitable for some minors.
We ask for your date of birth when you create an account to confirm that you are an adult. We do not retain your date of birth, only an age range. We use commercially reasonable methods to estimate the age of our users where required by applicable law.
We do not knowingly collect information from anyone under 18. If we learn that a user is under 18, we will close the account and delete the associated data. Consistent with the Children’s Online Privacy Protection Act, we do not knowingly collect information from children under 13, and if we learn we have done so we will delete it as quickly as possible and terminate the associated account.
Geographic Restriction
Alanna is offered only to individuals physically located in the United States, except where we expressly authorize otherwise in writing. By using Alanna, you represent that you are located in the United States. Access from outside the United States without authorization is prohibited.
Registration
To use Alanna you must create an account and provide accurate, current, and complete information. You agree to keep that information updated. You may not share your account credentials with anyone or transfer your account without our written permission. You are solely responsible for all activity that occurs under your account.
Account Deletion
You may delete your account and associated data at any time in Settings, or by contacting heyalannaai@gmail.com.
When you delete your account, we delete your data from our active systems within 30 days, notify our service providers to delete their copies, and remove your data from backups within six months. Limited records survive deletion, including payment records we must keep for tax purposes and a minimal record that you asked us to delete. Our AI provider may retain content its safety systems have flagged for up to two years on its own systems, which we cannot delete. Deletion cannot be reversed. See our Privacy Policy for the full detail.
4. Your Representations
As a condition of using Alanna, you represent and agree that:
- You are at least 18 years of age, have the legal capacity to enter these Terms, and have not provided false information to gain access.
- You will use the Services only for lawful purposes and in compliance with these Terms.
- You will not report false emergencies relating to yourself, others, or vulnerable populations including children, elders, or people with disabilities.
- You will not use the Services to harass, threaten, stalk, or attempt to locate or identify any individual, or to promote or incite violence or harm.
- You will not use automated programs, data mining tools, web crawlers, scrapers, or other data extraction tools in connection with the Services.
- You will not attempt to reverse engineer, decompile, disassemble, or discover the source code, models, prompts, or underlying components of the Services.
- You will not use the Services or any output from them to develop a competing product or model.
- You will not introduce viruses, malware, or other harmful code, attempt to breach security protocols, or otherwise interfere with the operation of the Services.
- You will not sell, resell, rent, sublicense, or otherwise commercially exploit the Services.
- You will not attempt to obtain another user’s password, account, or security information.
- You acknowledge that using Alanna on a device modified in a manner unauthorized by the manufacturer (“jailbroken” or “rooted”) may impair the Services and is a material breach of these Terms.
Violation of any of the above is grounds for immediate suspension or permanent termination of your account without notice or refund.
We reserve the right to take appropriate legal action, including referral to law enforcement, for any illegal or unauthorized use of the Services. You waive and hold us harmless from any claims resulting from any action taken during, or as a consequence of, investigations by us or by law enforcement authorities.
5. Alanna Allies
Alanna Allies are pseudonymous peer support groups of 10 to 15 caregivers, matched based on your onboarding questionnaire responses. Participation is optional.
How Allies Work
- Each Allies circle is a closed group. You can post, comment, and interact with other members of your circle.
- Participation is pseudonymous. Members are verified account holders. Your real name, email, phone number, and any other identifying information are never displayed to other members. Profile pictures are not permitted.
- Groups are moderated by our internal team. Moderation decisions, including whether a member may remain in a group, are made at our sole discretion.
- Posts and comments may be subject to automated flagging and manual moderation. Content that violates these Terms, harasses or identifies other members, is unlawful, or is otherwise harmful may be hidden or removed without notice, and may be preserved or reported where required by law.
Three-Strike Policy
You are given three warnings for conduct violations within Alanna Allies. After three warnings, your access to Allies will be revoked for a minimum of 3 months. After 3 months you may request reinstatement, which is not guaranteed and is granted at our sole discretion. We reserve the right to remove you immediately without prior warning for severe violations, including threats of violence, attempts to identify other members, sharing of sexual content, or content promoting abuse or neglect. Immediate removal carries a minimum 12-month ban.
Removal from Allies does not affect your access to Alanna’s chat, journal, affirmations, or any other feature.
Moderation
Allies circles are moderated by our internal team. Moderators can see the full content of posts and comments and can access your internal account identifier and moderation history in order to enforce these rules. Moderators cannot see your chatbot conversations, journal entries, or memory notes. Other members can never see your account information, real name, or moderation history.

Your Responsibilities in Allies
You agree that you will not:
- Attempt to identify, locate, or contact any other member outside of the Allies circle
- Share another member’s posts or comments outside of the group
- Share your own identifying information, such as your real name, location, workplace, or contact details
- Post images of any kind
- Harass, demean, exploit, or threaten any other member
- Solicit money, services, or business from other members
- Post content that is unlawful, abusive, discriminatory, sexually explicit, exploitative of minors, or otherwise prohibited by the Alanna Allies Moderation Policy
- Misrepresent your identity or caregiving situation
- Report false emergencies relating to yourself or others
Reporting and Blocking
Every post and comment in Allies includes a report button. You can report content you believe violates our community guidelines. Reports are anonymous to other members.
You can also block any member. Blocking hides their content from you and yours from them. Blocking is separate from moderation and does not trigger a strike against the other member.
Limits of Allies
We cannot guarantee the identity, honesty, or intentions of any member you interact with. Your interactions with other members are solely between you and them. We are not responsible for the conduct of any member.
Alanna Allies is not group therapy. It is not moderated by a licensed professional. The same disclaimers that apply to the rest of the Services apply fully to Allies.
If a dispute arises between you and another member, you agree that we are under no obligation to become involved. You release us from any claims, demands, and damages arising from disputes with other members.
6. Journal, Affirmations, and Push Notifications
Journal
The journal is a private space for your personal entries. Journal content is not shared with other users, not used for advertising, and not read by our team. You may set reminders and optionally link them to your personal calendar. If you connect a calendar, we access only what is needed to place the reminder.
Daily Affirmations
Alanna may deliver personalized affirmations based on your conversations and stated preferences. These are generated by AI and may not always feel right for the moment. You can adjust or turn off affirmations in Settings.
Push Notifications
We may send you push notifications, including conversation follow-ups, journal reminders, affirmation delivery, and service messages. You can turn off push notifications at any time. We will never send push notifications containing your conversation content, journal entries, or any sensitive information in the notification preview.
7. Ownership and License
Our Ownership
Alanna, including the Services, the software, our AI prompts and design, the branding, the written content, and the overall look and feel (together, the “Alanna Content”), is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, publicly display, reverse engineer, create derivative works from, or otherwise exploit the Alanna Content except as these Terms allow.
Your License to Use Alanna
Subject to your compliance with these Terms, we grant you a personal, limited, revocable, non-exclusive, non-sublicensable, non-transferable right to access and use the Services for your own personal, non-commercial use. All rights not expressly granted are reserved.
Your Content
Anything you share with Alanna is “Your Content.” You retain ownership of Your Content. You grant us a license to store, process, translate, modify for technical purposes, and reproduce Your Content solely as necessary to operate and provide the Services to you, including generating memory notes and personalized responses, consistent with our Privacy Policy.
Your conversations are not displayed to other users. They are stored securely to your account so that Alanna can maintain context between sessions.
We may access or review Your Content where we believe in good faith that doing so is reasonably necessary to detect, investigate, prevent, or address (i) violations of these Terms, (ii) threats of violence or harm to any person, (iii) risks to the safety of our users, our team, or the public, or (iv) obligations under applicable law, including mandatory reporting obligations.
We Do Not Train on Your Content
We do not use Your Content to train artificial intelligence models. Not our own, and not those of our AI provider. Your conversations are sent to our AI provider only to generate a response to you, and under our agreement with them that content is not used to train or improve their models.
If this ever changes, we will tell you clearly and obtain your consent first.
Feedback
If you send us ideas, suggestions, or feedback, you agree we may use them without restriction or compensation to you.
8. Subscription Fees, Renewal, and Cancellation
Free Trial
Alanna offers a 7-day free trial. Before your trial begins, we will disclose its length, the subscription fee that will apply when it ends, and the exact date of your first charge. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription and we or the applicable app store will charge the then-current fee. We will send you a written summary of these terms that you can keep.
Subscription Fees
Alanna is currently offered at $14.99 per month or $119.99 per year. Current pricing is always shown in the app and on heyalanna.com.
Automatic Renewal
Paid subscriptions renew automatically at the end of each subscription term for another term of the same length, at the then-current fee, until you cancel.
Before purchase, we will present the material renewal terms clearly and conspicuously and obtain the affirmative consent required by applicable law. Before your first charge we will send you a written summary of the key terms and conditions of your subscription, and we will ask you to confirm that you accept them. We may add, change, limit, or remove features, usage limits, or functionality over time.
By completing your purchase after those disclosures, you agree to automatic renewal and authorize us or the applicable app store to charge your payment method for each renewal term.
We will send renewal reminders where required by applicable law, including before annual renewals and before any renewal that extends your subscription past a further twelve months.
Cancellation
You can cancel at any time using the method that applies to your subscription. Cancellation must be completed before the applicable renewal or conversion date to avoid the next charge:
- If you subscribed through the Apple App Store or Google Play, cancel through your app store account settings.
- If you subscribed directly through our website, you can cancel online in Settings using the cancellation control provided with your subscription. You may also contact heyalannaai@gmail.com for assistance.
Cancellation takes effect at the end of your current subscription term, and you keep access until then.
Refunds
Except as required by applicable law, subscription fees are non-refundable, including if you stop using the Services before the end of your term. Purchases made through the Apple App Store or Google Play are subject to those platforms’ refund policies. To request a refund for a direct purchase, contact heyalannaai@gmail.com.
Price Changes and Notice
We may change our prices. We will give you advance notice of any fee increase or other material change to these subscription terms, and will obtain your consent where the law requires it. Any increase applies only to renewal terms beginning after we notify you.
Plan Variations
Features, usage limits, prices, trials, and promotional offers may differ between users and may change over time, including based on platform, geography, promotion, or testing programs. Participation in any version, test, or offer does not entitle you to any particular feature, price, or level of access on an ongoing basis.
Payment Processing
You authorize us to use a third-party payment processor and consent to the disclosure of your payment information to that processor. Your use of the Services is also subject to the terms and privacy policies of that processor and, where applicable, the app stores.
Insurance and Reimbursement
Subscription fees are not reimbursable by Medicare, Medicaid, Tricare, other government healthcare programs, commercial insurers, managed care organizations, or other payors.
Taxes
Fees are exclusive of applicable taxes, which we will charge separately where required.
9. Changes to the Services and These Terms
We are always working to improve Alanna, so the Services may change over time. We may add, modify, suspend, or discontinue features, or restrict access to parts of the Services.
We may update these Terms as Alanna evolves. If changes materially and adversely affect your rights, we will give you at least 30 days advance notice by email or in-app notification. Other changes take effect when posted. We will not begin charging you, increase your fees, or change your auto-renewal terms without first giving you advance notice and obtaining your consent where the law requires it.
If you do not agree to updated Terms, you must stop using the Services.
Software Updates
Our mobile applications may update automatically so you are always running the current version. You consent to these automatic updates, and these Terms apply to all updated versions.
Communications From Us
By creating an account, you agree that we may contact you about the Services, including account notices, subscription and billing notices, security alerts, and changes to these Terms or our Privacy Policy. These are service communications and you cannot opt out of them while you have an active account.
Marketing and promotional communications are separate and optional. You can opt out at any time through the unsubscribe link in any email or in your account settings, without affecting your access to Alanna.
10. Termination
You may stop using Alanna at any time by deleting your account or uninstalling the app.
We may suspend or terminate your access, or delete your account, if we determine that:
- You breached these Terms
- We must do so to comply with the law
- Your use could cause risk or harm to us, our users, or anyone else
- You are under 18
Termination for a violation may occur immediately, without notice, and without refund. If we terminate your account for a violation, you may not create another account, and we may take steps to prevent re-registration.
Upon termination, your account will be deactivated and your stored information will be deleted in accordance with our Privacy Policy.
If we discontinue the Services entirely before the end of your paid subscription term, we will provide a pro-rata refund for the unused portion.
Provisions that by their nature should survive termination will survive, including payment obligations, indemnification, liability limitations, intellectual property terms, and dispute resolution.
11. Disclaimer of Warranties
We will provide the Services using a commercially reasonable level of skill and care. Other than as expressly stated in these Terms:
Some states do not allow certain warranty disclaimers, so parts of this section may not apply to you.
12. Limitation of Liability
Some states do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless ALANNA APP LLC, its members, officers, employees, agents, and partners from and against any and all third-party claims, actions, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from or relating to:
- Your use of the Services
- Your violation of these Terms or any applicable law
- Your violation of the rights of any third party, including intellectual property and privacy rights
- Any content or information you provide, including information about any third party you may share with Alanna
- Your gross negligence, willful misconduct, or fraud
14. Third-Party Content and Links
Alanna may include links or references to third-party websites, crisis lines, or support organizations. We do not control and are not responsible for the content, accuracy, availability, privacy practices, or opinions expressed by those third parties.
15. Governing Law and Dispute Resolution
Governing Law
These Terms are governed by and construed under the laws of the State of Florida, without regard to its conflict of law principles.
Informal Resolution First
Before either of us files a formal claim, we both agree to try to resolve the dispute informally. You agree to notify us at heyalannaai@gmail.com and describe the issue. We will respond to the email address associated with your account. If we cannot resolve the dispute within 60 days, either of us may initiate arbitration. Any statute of limitations will be tolled during this period.
Binding Arbitration
Any dispute arising from or relating to these Terms or the Services that is not resolved informally will be finally settled by binding individual arbitration administered by JAMS under its then-current Streamlined Arbitration Rules and Procedures and, where applicable, the JAMS Consumer Arbitration Minimum Standards, by a single arbitrator. The hearing may be conducted remotely or at another location that is reasonably convenient to the consumer and consistent with applicable JAMS standards. Consumer arbitration fees will be allocated as required by applicable law and the applicable JAMS consumer standards. Judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this section.
Exceptions
This section does not require informal resolution or arbitration of: (i) individual claims brought in small claims court, or (ii) requests for injunctive or other equitable relief to stop unauthorized use of the Services or infringement of intellectual property.
Class and Jury Waiver
For the avoidance of doubt, claims relating to subscription fees, renewals, cancellations, refunds, or billing practices are subject to this arbitration and class action waiver.
Severability
If any part of this dispute resolution section is found unenforceable, the remainder stays in effect, except that if a finding of unenforceability would allow a class arbitration or class action, this entire section will be unenforceable in its entirety.
16. App Store Terms
These Terms apply to your use of all Services, including our applications available through the Apple App Store and the Google Play Store. The following additional terms also apply.
Apple
If you download Alanna on an Apple device, you and we acknowledge that these Terms are between you and us only, and not with Apple. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple will have the right to enforce these Terms against you as a third-party beneficiary.
- Alanna, and not Apple, is responsible for addressing any claims you may have relating to the app, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, claims under consumer protection or privacy legislation, and claims related to payment or refund of subscription fees.
- Apple has no obligation to furnish any maintenance or support services for the app.
- In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any.
- In the event of a third-party claim that the app infringes that party’s intellectual property rights, Alanna, and not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
- You will only use the app on an Apple device that you own or control, and in compliance with the Apple Media Services Terms and Conditions.
If you download Alanna from the Google Play Store: (i) these Terms are between you and us only, and not with Google; (ii) your use must comply with the then-current Google Play Terms of Service; (iii) Google is only a provider of Google Play and not of the app; (iv) Alanna, and not Google, is solely responsible for the app; (v) Google has no obligation or liability to you with respect to the app or these Terms; and (vi) Google is a third-party beneficiary of these Terms as they relate to the app.
Export Compliance
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
17. Copyright Complaints
If you believe content on the Services infringes your copyright, please send a written notice to our designated copyright agent at [DMCA AGENT CONTACT INFORMATION — COMPLETE BEFORE LAUNCH], with a copy to heyalannaai@gmail.com and the subject line “DMCA Takedown Request.” We register and maintain our designated agent with the U.S. Copyright Office in connection with the safe-harbor protections of 17 U.S.C. section 512.
Your notice must include:
- A physical or electronic signature of the person authorized to act on behalf of the copyright owner
- A description of the copyrighted work you claim has been infringed
- A description of where the allegedly infringing material is located, with enough detail for us to find it
- Your address, telephone number, and email address
- A statement that you have a good faith belief the disputed use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on their behalf
We reserve the right to remove or disable content alleged to be infringing, and we will terminate the accounts of repeat infringers in appropriate circumstances.
18. General Terms
Events Beyond Our Control. If our provision of the Services is delayed or interrupted by an event outside our reasonable control, including outages at our hosting or AI providers, we will let you know as soon as we can and take reasonable steps to minimize the disruption.
Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations without consent, including in connection with a merger, acquisition, or sale of assets.
Severability. If any provision of these Terms is found unenforceable or invalid, it will be limited or eliminated to the minimum extent necessary, and the remaining provisions will stay in full force.
No Waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
Survival. Provisions that by their nature should survive termination will survive.
No Third-Party Beneficiaries. Except as expressly stated in the App Store Terms section, these Terms do not create any third-party beneficiary rights.
Relationship. These Terms do not create any partnership, joint venture, fiduciary, employment, or agency relationship between you and us.
